1. Introduction

Welcome to Pure Flow ("Company", "we", "our", "us"). These Terms of Service govern your use of our website located at lipkaya-utka.com (the "Site") and our water delivery services (collectively, the "Services"), operated by Pure Flow.

By accessing our Site or using our Services, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you do not have permission to access the Services.

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the Services thereafter.

2. Definitions

The following terms when used in these Terms of Service shall have the following meanings:

  • "Customer", "you", "your" refers to any individual or organization that orders or uses our Services.
  • "Services" refers to water delivery, equipment rental, maintenance, and other related services provided by Pure Flow.
  • "Equipment" refers to water dispensers, coolers, stands, and any other equipment provided by Pure Flow as part of our service offerings.
  • "Products" refers to water bottles, water containers, and any consumable items sold by Pure Flow.
  • "Delivery Schedule" refers to the agreed upon frequency and timing of water deliveries.
  • "Service Agreement" refers to the contract between Pure Flow and the Customer for the provision of ongoing Services.

3. Our Services

3.1 Service Description

Pure Flow provides water delivery services, including but not limited to:

  • Delivery of bottled water to homes and businesses
  • Rental and sale of water dispensers and related equipment
  • Maintenance and sanitization of water equipment
  • Custom water solutions for events and special occasions
  • Subscription-based recurring delivery services

3.2 Service Area

Our delivery services are available within specific geographic areas within the United Kingdom. Service availability varies by location. You can check if delivery is available in your area by entering your postcode on our website or by contacting our customer service team.

3.3 Service Quality

We are committed to providing high-quality products and services. All of our water products meet or exceed UK water quality standards. Our equipment is regularly maintained and sanitized according to industry best practices.

4. Ordering and Delivery

4.1 Placing Orders

Orders can be placed through our website, by phone, or via email. When placing an order, you must provide accurate and complete information, including delivery address, contact information, and any special delivery instructions.

4.2 Order Acceptance

All orders are subject to acceptance by Pure Flow. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in product or pricing information, or problems identified by our credit and fraud avoidance department.

4.3 Delivery

We will deliver products to the address specified in your order or service agreement. Standard delivery times are between 8:00 AM and 6:00 PM, Monday through Friday, excluding holidays.

For recurring deliveries, we will establish a regular delivery schedule based on your consumption needs and preferences. You will be notified in advance of planned delivery dates.

4.4 Access Requirements

You are responsible for ensuring that our delivery personnel have safe and appropriate access to the delivery location. This includes providing any necessary entry codes, keys, or access permissions, and ensuring that the delivery path is clear and safe.

4.5 Delivery Confirmation

Our standard practice is to leave deliveries in a safe, sheltered area at the delivery address. If you require a signature upon delivery, this must be arranged in advance, and additional fees may apply.

4.6 Failed Deliveries

If we are unable to complete a delivery due to inaccessibility, absence of the recipient (when signature is required), or other customer-caused reasons, we may charge a failed delivery fee. We will attempt to contact you to reschedule the delivery, which may result in additional charges.

5. Pricing and Payment

5.1 Pricing

Current prices for our products and services are available on our website or by contacting our customer service team. All prices are listed in British Pounds (£) and include VAT where applicable.

We reserve the right to change our prices at any time. For customers with ongoing service agreements, we will provide at least 30 days' notice before any price changes take effect.

5.2 Payment Methods

We accept payment by credit card, debit card, direct debit, and bank transfer. For business customers, we may offer invoice payment terms subject to credit approval.

5.3 Billing Cycles

For one-time orders, payment is due at the time of ordering. For subscription services, we offer monthly, quarterly, or annual billing cycles. Payment for subscription services is processed in advance of the service period.

5.4 Late Payments

Payments not received by the due date are considered late. We reserve the right to charge late payment fees and/or interest on overdue amounts at the rate of 4% above the Bank of England base rate, calculated daily from the due date until payment is received.

For subscription services, we may suspend deliveries if payment is not received within 7 days of the due date. A reconnection fee may apply to resume service after suspension for non-payment.

5.5 Promotions and Discounts

We may offer promotional discounts from time to time. All promotions and discounts are subject to specific terms and conditions, which will be communicated at the time the promotion is offered.

6. Equipment Rental and Maintenance

6.1 Equipment Ownership

All rented equipment remains the property of Pure Flow. The customer is not authorized to sell, sublease, modify, or otherwise transfer the equipment to any third party.

6.2 Equipment Care

You are responsible for the proper care and use of any equipment provided by Pure Flow. This includes:

  • Using the equipment only for its intended purpose
  • Following all provided operating instructions
  • Keeping the equipment in a clean, safe environment
  • Preventing damage, theft, or unauthorized use
  • Notifying us promptly of any malfunction or damage

6.3 Maintenance and Repairs

Pure Flow will provide regular maintenance and sanitization of rented equipment according to the schedule specified in your service agreement. Additional maintenance visits may incur extra charges.

We will repair or replace malfunctioning equipment at no additional cost, provided that the malfunction is not due to misuse, unauthorized modification, or damage caused by the customer.

6.4 Damage or Loss

You are responsible for any damage to or loss of equipment resulting from negligence, misuse, or failure to follow operating instructions. In such cases, you will be charged for repair or replacement costs.

6.5 Return of Equipment

Upon termination of your service agreement, you must return all rented equipment to Pure Flow in good condition, normal wear and tear excepted. We will arrange for the collection of equipment at a mutually convenient time.

If equipment is not returned within 14 days of service termination, you may be charged a replacement fee equal to the current retail value of the equipment.

7. Cancellation and Refunds

7.1 Cancellation of Orders

One-time orders can be cancelled free of charge up to 24 hours before the scheduled delivery date. Cancellations made less than 24 hours before delivery may incur a cancellation fee of up to 50% of the order value.

7.2 Subscription Cancellation

For subscription services, cancellation terms are specified in your service agreement. Typically, we require 30 days' written notice for cancellation of ongoing services.

Customers on fixed-term contracts may be subject to early termination fees if cancelling before the end of the agreed term. These fees will be clearly specified in your service agreement.

7.3 Cooling-Off Period

For contracts entered into online or over the phone, UK consumers have a right to cancel within 14 days of the contract date without penalty (the "cooling-off period"). This does not apply to business customers or to products that have been unsealed or used.

7.4 Refunds

Refunds for cancelled orders will be processed using the original payment method within 14 days of cancellation approval.

For subscription services, we will refund any prepaid amounts for services not yet received, less any applicable cancellation or early termination fees.

7.5 Quality Issues

If you are not satisfied with the quality of our products or services, please contact us within 5 days of delivery. We will investigate all quality concerns and may offer replacement, credit, or refund at our discretion.

8. Limitation of Liability

8.1 Service Commitments

We strive to provide reliable services, but cannot guarantee that our services will be uninterrupted, timely, or error-free. We reserve the right to suspend or modify our services temporarily for maintenance or other operational reasons.

8.2 Limitation of Liability

To the maximum extent permitted by law, Pure Flow shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use our services
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from our services
  • Any bugs, viruses, or other harmful code that may be transmitted to or through our services
  • Any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content

8.3 Maximum Liability

In no event shall our total liability to you for all claims exceed the amount paid by you to Pure Flow during the 12 months preceding the event giving rise to the liability.

8.4 Exceptions

Nothing in these Terms of Service excludes or limits our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot be excluded or limited by law

9. Intellectual Property

9.1 Ownership

The Service and its original content, features, and functionality are and will remain the exclusive property of Pure Flow and its licensors. The Service is protected by copyright, trademark, and other laws of both the United Kingdom and foreign countries.

9.2 Use Restrictions

You may not use our name, logos, or trademarks without our prior written consent. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our website, except as follows:

  • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials
  • You may store files that are automatically cached by your web browser for display enhancement purposes
  • You may print or download one copy of a reasonable number of pages of the website for your own personal, non-commercial use and not for further reproduction, publication, or distribution

10. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our Services after any changes to the Terms of Service constitutes your acceptance of such changes.

For material changes to these Terms, we will make reasonable efforts to provide notice through our website or by contacting you directly.

It is your responsibility to review these Terms periodically for changes. If you do not agree to the modified terms, you should discontinue your use of our Services.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms of Service, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by the courts of England and Wales, which shall have exclusive jurisdiction over any such dispute.
